I am in the same boat. I have emailed countless number of times and had excuse after excuse. Not a penny back.
 
I have rcieved some kind of document scanned from BCP showing that the developer has sent my funds to the notary and the notary has made the request to the office exchange.
 
I did not elect to pay monthly, I was paying yearly, although I did put in my refund request a couple of months later as I was undecided about taking the refund or buying in to the new development. That was a mistake.
 
My only thought now is that we get someone who can speak fluent french to draft us out an email and we send it directly to the office exchange, maybe when they get a letter from a real person it may carry more weight than from a solicitor who they must deal with all the time. ie try to appeal to them and understand first hand what is causing the delay.

If you read my previous posts it explains about the court proceedures.
As long as your lawyer agrees that delays are not due to (force Majeure)
Which means act of god various lawyers have indicated the the chances of winning a case against the developers is high.

We put a 40% deposite on a 2-bed penthouse in Asilah Home Beach development back in 2006. The forcast was to complete within 22-24 months but they said the license was delayed until 2008. However, we are still waiting! We received a letter from Prestige saying we're entitled for a compensation since January 2011 but don't know how to start the process and take the developers to court. can you please give us a pointer. Sorry but I'm not ignoring you and I hope that you are well.
The Office Exchange has not yet informed us about your file together with
others 4 files which is strange. They have sent the reply for others clients
and we have sent last week and this one the funds to others clients. We have
requested an appointment with them in order to know why this not reply.
Probably you will receive your funds at the end of this month as they will
do quickly as you are in the last batch of clients.
Sorry for any inconvenience that this process has caused to you. Dreamworld
has sold a very bad schedule of payments which is to pay each month as this
is has been very bad for you. I can confirm to you that your money is safe
with the Notary just you have to wait this formality.

Hope that this email finds you well and apologies.

The Notary has confirmed that he has been requested by the Exchange Office
to provide evidence about the permits already granted and the funds
transferred abroad so he is very reluctant to deal with further permits and
repatriation until they close their enquiries.

I will be there on the Office Exchange on the 16th April and then I will can
inform you and sorry again.

Have emailed to see what happened on the 16th no reply, so looks like most have had there cash back but we are going to have to wait or not get back at all,

Shocking this is, sent all my info last December so 16 months on the clock not a penny back, most  other investors sorted and getting there 3% back in Morocco


its supposed to be down to the way we opted to pay the instalments, getting penalised as we have done this monthly, if we had opted for dreamworlds quarterly or yearly payment we would off had funds back to us by no apparently.

Getting really concerned this is not going to happen and really not sure what else to do..

I havent had any refund so far.
 
Ragdha seems to be increasingly evasive, sending back a brief response for every 2-3 emails I send her.
 
Her latest email just said many delays from the developer.
 
Very exhausting.
